The competition watchdog has begun legal proceedings against two WA egg wholesalers, who they allege have incorrectly labelled their eggs free range.
The Australian Competition and Consumer Commission today announced the Perth Federal Court case against C.I & Co Pty Ltd, and Antonio and Anna Pisano who have traded as C I & Company for the alleged breaching of the Trade Practices Act.
The ACCC will allege that from January 2006 to about June 2008 C.I. & Co Pty Ltd sold eggs in cartons with the words "free range eggs" featured prominently on them when they were not.
It is alleging the same for C I & Company, who also used the words "Fresh-Range Omega-3" on their cartons between April and June this year, the watchdog said.
The incorrect labelling breached several sections of the Act including those directing businesses not to engage in misleading or deceptive conduct or falsely represent goods.
"The ACCC seeks declarations, injunctions and orders for costs against all parties, corrective notices by Antonio Pisano and Anna Pisano, and an order imposing a civil pecuniary penalty on Antonio Pisano," the ACCC said.
A directions hearing is listed for 10.30 a.m. on Monday, 25 October 2010, before Justice Barker.
